Website Service Agreement

This Website Service Agreement (the “Agreement”) outlines the terms and conditions for the services provided by Flow & Design (“we,” “our,” or “us”) to clients (“you” or “your”). By purchasing our services, you agree to the terms outlined in this Agreement.

This policy works in conjunction with the Terms & Conditions and Refund and Returns Policy.

By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access or use the Services.

1. Scope of Services

1.1 Done-for-You Website Services

We provide custom website design and development services, including:

  • Website setup, template installation, and customization.
  • Domain and hosting integration (if applicable).
  • Additional features as specified in your selected service package.

1.2 Subscription-Based Website Services

  • Monthly or annual subscriptions for website maintenance, updates, and hosting management.
  • Scope of services is determined by your subscription tier via Pricing

1.3 Add-On Services

  • SEO optimization.
  • Content writing.
  • Website maintenance.

1.4 Limitations of Services

  • Services do not include external integrations or third-party customizations beyond what is specified in the package.
  • You are responsible for providing necessary information (e.g., branding materials, content, or access credentials) in a timely manner.

1.5 Marketplace Subscriptions

  • Templates are sold as is and are non-refundable.
  • Marketplace Subscriptions are non-refundable however you may cancel or pause anytime. Just contact us or access your Billing

2. Payment Terms

2.1 Payment Methods

We accept payments through Stripe and other approved payment gateways listed on our website.

2.2 Refund Policy

  • We offer a 100% refund if we are unable to start your project. We’ll contact you through the email you payed with or signed up with if we, for whatever reason are delayed to or unable to start your project. Please allow 48 hours for us to contact you after payment. To speed this up you can contact us.
  • Refunds are not applicable once work has begun or for completed projects (applies to all services and service based subscriptions)
  • Templates are sold as is and are non-refundable.
  • Marketplace Subscriptions are non-refundable however you may cancel or pause anytime. Just contact us or access your Billing

2.3 Subscription Payments

  • Subscription payments are billed automatically based on your selected frequency (monthly or annual).
  • You may cancel your subscription at any time, but payments already processed are non-refundable.

2.4 Late or Failed Payments

  • Late payments may result in the suspension of services.
  • You will be notified via email to resolve payment issues within 7 days to avoid service termination.

3. Client Responsibilities

3.1 Information and Materials

You are responsible for providing all required materials and access credentials in a timely manner to ensure the project progresses as scheduled.

3.2 Communication

You agree to respond promptly to our requests for information, approvals, or additional materials.

3.3 Adherence to Policies

Failure to adhere to our communication and material submission timelines may result in project delays or cancellation.

4. Timeline and Delivery

4.1 Project Timeline

Timelines will be outlined in the initial project scope. Delays caused by the client (e.g., late material submissions) may result in revised delivery dates.

4.2 Delivery Milestones

Deliverables will be provided based on milestones agreed upon during project initiation.

5. Intellectual Property

5.1 Ownership of Materials

  • Upon full payment, you own the final deliverables for custom website design projects.
  • Pre-made templates or licenses remain the intellectual property of Flow & Design and are subject to usage limitations as specified.

5.2 Use of Templates

  • Templates are for personal or business use only.
  • Redistribution, resale, or unauthorized sharing of templates is prohibited.

6. Modification and Termination of Services

6.1 Modifications

We reserve the right to modify the scope or pricing of services with 30 days’ notice. Changes will not affect current projects or subscriptions during their active term.

6.2 Termination

  • You may terminate the agreement at any time by providing written notice. Refunds are subject to the Refund Policy.
  • We reserve the right to terminate the agreement if the client violates the terms outlined herein.

7. Limitation of Liability

We are not liable for:

  • Issues arising from third-party integrations, hosting, or domain registrars.
  • Performance outcomes, including website traffic, sales, or SEO rankings.
  • Losses resulting from delays caused by the client’s failure to provide necessary materials or approvals.

8. Dispute Resolution

8.1 Mediation

In the event of a dispute, both parties agree to attempt mediation before pursuing legal action.

8.2 Jurisdiction

This Agreement is governed by the laws of California.
